Terms of Service

Christmas Elves, LLC
Effective Date: August 25, 2025

By accepting an estimate from Christmas Elves, LLC (“we,” “our,” or “us”), you (“Client,” “you,” or “your”) agree to the following terms and conditions.

1. Acceptance of Estimate

Approval of any estimate constitutes your agreement to these Terms of Service and confirms your intent to move forward with the proposed work.

2. Deposit Requirement

A 50% non-refundable deposit is required to secure your installation date. No scheduling will occur until the deposit is received.

Accepted payment methods:

  • Credit card

  • Debit card

  • Cash

  • Check

  • ACH or other methods agreed upon in writing

3. Final Payment

The remaining 50% balance is due immediately upon completion of the installation.
Failure to pay within 3 business days may result in:

  • Late fees

  • Temporary removal of installed materials

  • Suspension of future services

​

4. Cancellation & Refunds

All deposits are non-refundable.
If you wish to cancel or reschedule:

  • Notice must be given at least 48 hours in advance

  • Failure to notify us within 48 hours will result in forfeiture of your deposit

​

5. Rescheduling

Rescheduling is permitted with at least 48 hours’ notice and is subject to calendar availability. Weather-related reschedules may occur at our discretion.

6. Scope of Work

The estimate reflects the scope of work discussed during your consultation.
Changes, additions, or upgrades not included in the original estimate will require a revised quote and may result in additional charges.

7. Installation Standards

Installations will be performed in a professional and safe manner using best industry practices. However, timelines are subject to weather, access to the property, and other uncontrollable factors.

8. Warranty & Maintenance

We offer a limited warranty for the duration of the holiday season on all installations performed by Christmas Elves, LLC.
Under this warranty, we will repair or replace:

  • Any light strand or material installed by us that fails under normal use

  • Any light or clip that falls or malfunctions due to installation error

Warranty does not cover:

  • Customer tampering

  • Weather or animal damage

  • Lights or materials not installed by us

Service calls outside of warranty coverage may incur a standard service fee.

9. Liability Disclaimer

Christmas Elves, LLC is not responsible for:

  • Pre-existing damage to gutters, shingles, fixtures, or landscaping

  • Damage due to roof wear, improper home construction, or nonstandard surfaces

  • Injuries or damage caused after installation due to tampering, misuse, or third-party interference

We guarantee that all installations comply with local codes and are performed using OSHA-compliant safety protocols.

Unsafe Conditions Clause: If work cannot be performed due to unsafe conditions (including unstable roofs, unpruned trees, or any hazard identified by our team), Christmas Elves, LLC is not liable for any delays, damages, refunds, or reschedules. Any deposit or payments made remain subject to our standard cancellation and refund policy.

10. Ownership of Materials

All lighting, clips, and installation materials remain the property of Christmas Elves, LLC unless explicitly stated in writing. These materials will be removed during takedown unless a purchase agreement has been made.

11. Governing Law

This agreement is governed by the laws of the State of South Carolina. Any disputes shall be resolved in the jurisdiction of Charleston, South Carolina.
